COMMCARE WAIVER

A Home and Community-Based Services Waiver for Individuals with Traumatic Brain Injury (TBI).

If you have a medically determined Diagnosis of traumatic brain injury (TBI), the COMMCARE Waiver can help you remain as independent as possible.

ELIGIBILITY:
  • Be a Pennsylvania resident
  • Be 21 years of age or older
  • Have a medically determinable diagnosis of traumatic brain injury and require a Special Rehabilitative Facility (SRF) level of care
  • Your disability must result in substantial functional limitation in three or more of the following major life activities:
  • Mobility
  • Behavior
  • Communication
  • Self-care
  • Self-direction
  • Capacity for independent living
  • Cognitive capacity (judgment, memory and reasoning).
  • Meet the financial requirements as determined by your local County Assistance Office.

INDEPENDENCE WAIVER

If you are an adult with a severe physical disability, the Independence Waiver may be able to help you live or remain in the community and remain as independent as possible.

ELIGIBILITY:
  • Be a Pennsylvania resident
  • Be 18-60 - Individuals who are currently in the waiver prior to 7/1/2006 will age in place. Individuals age 60 and older will be referred to the Aging Waiver.
  • Individuals who are physically disabled (but not with mental retardation or have a major mental disorder as a primary diagnosis, or who are ventilator dependent), who reside in a Nursing Facility (NF) or the community but who have been assessed to require services at the level of nursing facility level of care.
  • In addition, the disability must result in substantial functional limitations in three or more of the following major life activities.
  • Self-care, understanding and use of language, learning, mobility, self-direction and/or capacity for independent living.
  • Meet the financial requirements as determined by your local County Assistance Office.
SERVICES:

  • Assistive technology/specialized medical equipment and supplies
  • Community integration services
  • Community transition services
  • Education services
  • Environmental adaptations
  • Extended state plan - visiting nurse, physical therapy, speech therapy, occupational therapy, and behavior therapy

ATTENDANT CARE WAIVER/ACT 150 PROGRAM

If you have a physical disability, the Attendant Care Waiver and state funded Act 150 program may be available to you to continue to live in your home and community with support and services.

ELIGIBILITY:
  • Be a resident of Pennsylvania
  • Meet the level of care needs for a Skilled Nursing Facility or a Special Rehabilitation Facility for the Medicaid Waiver. Those who do not meet the Skilled Nursing Facility or Special Rehabilitation Facility level of care MAY qualify for the PA State funded Act 150 Program
  • Be between eighteen (18) and fifty-nine (59) years of age
  • Be capable of a) hiring, firing, and supervising attendant care worker(s); b) managing your own financial affairs; and c) managing your own legal affairs
  • For the Medicaid Home and Community Based Waiver Services Attendant Care Program, meet the financial requirements as determined by your local County Assistance Office.
  • Have a medically determinable physical impairment that is expected to last of a continuous period of not less than twelve (12) calendar months or that may result in death
  • To take advantage of the Attendant Care Act 150 Program, you may be assessed a minimal co-payment. This co-payment is based on your income and will not be more than the total costs of services

CONSOLIDATED WAIVER

The Pennsylvania Consolidated Waiver for individuals with mental retardation is designed to help persons with intellectual disabilities live more independently in their homes and communities and to provide a variety of services that promote community living, including self-directed service models and traditional, agency-based service models.

ELIGIBILITY:
  • Be age three and older
  • Have a diagnosis of mental retardation
  • Require active treatment
  • Be recommended for an intermediate care facility level of care based on a medical evaluation
  • Determined eligible for Medical Assistance (MA)
  • $2,000 resource limit (does not apply to dependent children under age 21)
  • Income limit 300% of the Federal Benefit Rate

PFDS WAIVER

The Pennsylvania Person/Family Directed Support Waiver is designed to help persons with developmental disabilities live more independently in their homes and communities and to provide a variety of services that promote community living, including self-directed service models and traditional, agency-based service models.

ELIGIBILITY:
  • Be age three and older
  • Have a diagnosis of mental retardation
  • Require active treatment
  • Be recommended for an Intermediate Care Facility/Mental Retardation level of care based on a medical evaluation
  • Determined eligible for Medical Assistance
  • $2,000 resource limit (does not apply to dependent children under age 21)
  • Income limit 300% of the Federal Benefit Rate
  • Individual cost limit of $26,000 per person per fiscal year (excluding supports coordination)
  • Does not require Office of Developmental Programs licensed community residential services

OBRA WAIVER

The OBRA Waiver is a Home and Community Based Waiver program that may help you if you have a developmental physical disability to allow you to live in the community and remain as independent as possible.

ELIGIBILITY:
  • A resident of Pennsylvania.
  • Age 18-60. Age 18-60 individuals who are currently in the waiver prior to 7/1/2006 will age in place. Individuals age 60 and older will be referred to the Aging Waiver.
  • Have a severe developmental physical disability requiring an Intermediate Care Facility/Other Related Conditions (ICF/ORC) level of care.
  • The disability must result in substantial functional limitations in three or more of the following major life activities:
  • Mobility
  • Communication
  • Self-care
  • Self-direction
  • Capacity for independent living
  • Learning

Meet the financial requirements as determined by your local County Assistance Office. Other related conditions (ORCs) include physical, sensory, or neurological disabilities which manifested before age 22 and are likely to continue indefinitely.

AUTISM WAIVER

In order to be eligible for the Adult Autism Waiver, a person must be age 21 or older, a U.S. citizen or qualified alien, a resident of Pennsylvania (or planning to be a resident at the time of enrollment) and meet certain diagnostic , financial and functional eligibility criteria listed below. Priority is given to people not already receiving ongoing state funded or state and federally funded, long-term care services.

Diagnostic Criteria:
  • Must have a diagnosis of an autism spectrum disorder,ASD, which includes:
    • Autistic Disorder
    • Pervasive Development Disorder, Not Otherwise specified (PDD-NOS)
    • Asperger Syndrome
    • Childhood Disengretitive Disorder
    • Retts Disorder

Must have substantial functional limitations that are likely to continue indefinitely in three or more of the major life activities listed below. These functional limitations, which must be evident before the person reaches the age of 22, include limitations in:

ELIGIBILITY CRITERIA:
  • There is no age limit for individuals with an intellectual disability or autism. Individuals with a developmental disability with a high probability of resulting in an intellectual disability or autism are eligible from age 0 through 8

    • Medical Evaluation
    • Diagnosis of an intellectual disability, autism, or developmental disability
  • Recommended for an intermediate care facility (ICF) level of care based on a medical evaluation
  • Determined eligible for Medical Assistance (MA)
  • Meet the financial requirements as determined by your local County Assistance Office
  • Individual cost limit of $70,000 per person per fiscal year (Supports Coordination is excluded from this limit)
